What types of meetings receive compensation?
IEP, SST, or 504 meetings that occur outside the duty day are eligible for compensation.
How am I compensated?
The facilitator of the IEP, SST, or 504 meeting is paid at the Facilitator rate which is on the certificated hourly timesheet.
Certificated participants are paid at the Curriculum Development rate. Participants include certificated employees such as Speech Pathologists, School Psychologist, General Education Teacher, and Literacy Coaches.
How many facilitators can there be?
There can only be one facilitator per meeting. This is typically the case manager, SST Coordinator or school counselor. Everyone else is a participant.
What circumstances trigger IEP, SST or 504 compensation?
Any meeting that goes fifteen minutes or more beyond the duty day.
If I receive an SST stipend, can I also be paid for after the duty day meetings?
No. The SST stipend already serves as a vehicle for compensation. Like IEPs and 504 meetings, attempts should be made to conduct these within the duty day.
Am I compensated for the fifteen minute ‘grace period’?
If the meeting goes beyond fifteen minutes, yes, the entire time after the duty day is compensated. If IEP/SST/504 meetings extend past 15 minutes after the end of the duty day, the meeting facilitator will be paid the Facilitator Rate for the totality of the time. If IEP/SST/504 meetings extend past 15 minutes after the end of the duty day, certificated participants will be paid at the curriculum development rate for the totality of the time.
What if a meeting goes less than 15 minutes past my duty day?
If a meeting goes less than 15 minutes after the duty day, you can receive inservice credit for the time beyond the duty day. If the meeting is completely within the duty day, inservice credit does not apply.
How do I know my duty day?
Every site should have an established duty day that begins before students arrive and ends seven hours and ten minutes later for classroom teachers and school counselors. You can see all of the BUSD schools HERE.
How do I know if my administrator approved a meeting outside the duty day?
For IEP meetings, there is an administrator that has to be in the meeting so by them saying they can attend, they essentially have approved it. If an administrator isn’t in a 504 or SST by default, include them on the invite so they know it is happening. Every side should have a master document (or spreadsheet) where every meeting shall be recorded.
What exceptions are there to the seven hour and ten minute duty day?
Part-time teachers have a prorated duty day and is typically case by case. Secondary 1.0 TSAs, District TSAs, SLPs and School Psychologists have an eight hour duty day. General Education Preschool teachers and BEARS teachers have a seven hour day. TK-8 music teachers duty day may exceed seven hours and 10 minutes and is established as thirty five hours and 50 minutes over the course of the week.
Can I be forced to attend a meeting outside the duty day?
No. Meetings should be scheduled when the people that need to be there are available.
Can I choose to schedule a meeting outside the duty day?
IEP, 504 and SST meetings should only be scheduled outside the duty day when there is a specific reason to do so and a meeting during the day cannot be scheduled. One reason this might happen is because of caregiver availability.
Can an IEP, 504 or SST meeting be scheduled during my prep period?
Yes. According to our contract, this should not happen more than once per week. This is already paid time.
Can an IEP, 504 or SST meeting be scheduled during my duty free lunch?
Lunch meetings should be avoided if at all possible. You cannot be forced to work during your duty free lunch. If a lunch meeting does occur, all participants would need to agree to that time and that time should be paid for. Any paid time on timesheets needs administrator approval.
Is there a limit to how many hours I can claim?
This is a maximum of 15 hours a year that can be compensated. Any time in excess of 15 should be submitted on an in-service credit form.
